Planning Appeals

RBA Town Planning is helping residents throughout Pontefract, Wakefield, Doncaster and Barnsley appeal against the refusal of planning permission. The refusal of your application does not necessarily mean all is lost, with every refusal you have a right to submit an appeal. Appeals are dealt with by Planning Inspectorate, and like RBA, work independently to the Local Councils. Only a small percentage of refusals are challenged, approximately 50% of those challenged the Inspectorate overturns and grants planning permission. We have a high success rate winning on average 80% of appeals submitted.

How will I know whether to Appeal?

When should I appeal?

You should commence appeal proceedings as soon as possible, the Planning Inspectorate must receive the relevant appeal documents within 12 weeks of the decision date; late appeals are turned away and the right to appeal is lost. Good appeal submissions take time to prepare so the early instruction is always an advantage.

How does it work?

We take care of everything, from instruction we begin to work on preparing an appeal statement to evidence why the planning application should be approved, robustly challenging the opinion of the Council. Once the Appeal Statement and evidence are ready it is submitted to the Inspectorate using their secure online portal.

Once the appeal is validated, the Council are notified and they have a short window in which to send the application documents and the justification for refusal. The Inspectorate then appoints a Planning Inspector to assess the case and visit your property, the inspector will then independently issue a decision within a few weeks of the visit.

The decision is usually issued within 10 and 12 weeks.
